Since 27th February 1997 divorce has been lawful in Ireland. The grounds for divorce in Ireland are;

 
   
    1 That the couple have lived apart for a period of 4 years during the past 5 years.  
   
    2 That there is no prospect of a reconciliation.  
   
    3

Such provision as the Court considers proper with regard to the circumstances exist or will be made for the spouse or any dependent members of the family.

 
 
 

Once the parties satisfy the period of separation and state that there is no prospect of a reconciliation and after the Court has been satisfied that proper provision has been made with regard to the dependent spouse and child, an order for divorce can be made.

As regards financial settlement the Court can make a variety of orders including lump sum, periodical payments, property adjustment orders and pension adjustment orders.

Orders relating to children can be made.

Most applications are made in the Circuit Court, but more difficult cases (including ones involving large sums of money) will be dealt with by the High Court. About 5000 divorces are granted every year in Ireland.
