Divorce means that one party regards the marriage as having broken down irretrievably. This must be proven by one or more of 5 facts,

 
   
    1 Adultery.  
   
    2

Unreasonable behaviour of the other party eg violence, excessive drinking, neglect, making excessive sexual demands, associating intimately with another man or woman (short of adultery), keeping the other party unreasonably short of money.

  
   
    3 Living apart for two years and the other party consents to the divorce.  
   
    4 Living apart for five years (consent of other party not required).

Desertion by the other party for two years. Undefended divorces are heard and pronounced in the divorce County Court in what is essentially an administrative procedure. The parties do not have to attend court. Defended divorces are rare and require a full hearing in open court. Financial provision and property adjustment orders can be made in connection with proceedings for divorce.
