Cohabiting Couples

The Family Law (Scotland) Act 2006 has provided cohabiting couples with more rights than ever before and they now have similar rights to those of married couples.  This is especially in relation to financial support and the division of all assets acquired within the period of the parties relationship.

When you and your partner separate, there can be many issues that need taken care of.  Who will the children live with?  What about the sale of the house?  How do other assets come into consideration, like pensions or the family car?  The best way forward is to finalise all matters by way of a SEPARATION AGREEMENT.  All assets and debts are taken into consideration as at the date of separation and any assets are usually divided equally between the parties unless one party has the burden of care for any children. This doesn’t involve going to court.  Your solicitor can obtain all the required information from you and create an agreement for signature by both you and your partner.  Notably both parties must fully disclose all their asset and debt details to ensure validity.
